DMV SECURES SUMMARY JUDGMENT IN FAVOR OF CITY OF READING
Associate, Daniel Gradwohl obtained summary judgment in favor of the client, City of Reading, in a case involving a fatal motorcycle crash. Plaintiff alleged that a defect in the street caused a speeding motorcycle to crash into a utility pole, killing the 19-year-old female passenger. A Berks County judge granted summary judgment after review of the motion as well as oral argument, finding that there was no evidence that the condition of the street was defective or that the motorcycle even encountered any potential defect which would have caused the operator to lose control. The case had been pending for more than 6 years, with extensive discovery and motions filed prior to the dismissal of all claims against the City of Reading.
