DMV Secures a Defense Verdict in Philadelphia Court of Common Pleas
Partner, Frank Deasey and associate, Daniel Gradwohl successfully defended NET Treatment Services, Inc. following a seven-day jury trial in Philadelphia County. The case involved the tragic death of a four-month-old baby. NET Treatment Services, Inc. was contracted by the Philadelphia Department of Human Services “DHS” to provide in-home services to the child and his family. Plaintiff’s counsel argued that the child should have been removed from his home and as a result died from suffocation due to co-sleeping with his mother. However, the scientific evidence showed that the death was due to Sudden Infant Death Syndrome “SIDS.” Moreover, NET Treatment Services, Inc. provided the necessary services to try to keep the family intact. After less than three hours of deliberation, the jury returned a verdict finding that NET Treatment Services, Inc. was not negligent in providing services to the family.
