DMV Obtains Dismissal on Motion for Judgment on the Pleadings in Luzerne County

On July 9, 2020, DMV Partners, Francis J. Deasey and Matthew J. Junk, obtained a complete dismissal for a client after filing and arguing a motion for judgment on the pleadings in Luzerne County, Pennsylvania. The judgment was obtained on behalf of one of the firm’s mental health provider clients.  The mental health provider had been sued for allegedly failing to protect the plaintiffs and prevent the actions of a mental health patient.  DMV’s attorneys successfully argued that the plaintiffs in that case failed to establish a cause of action under Pennsylvania law, resulting in the client’s dismissal from the case.
