DMV Obtains Dismissal of Municipality from FHA and ADA Claims
Rufus Jennings recently successfully argued for the dismissal of a claim under the Fair Housing Act and Americans with Disabilities Act on behalf of a municipal client. The claim concerned the installation of a mobile home in a resident’s driveway to be used as an on-site classroom. The District Court initially denied an application for a preliminary injunction, agreeing that “Plaintiffs have failed to address, much less meet, any of the preliminary injunction prerequisites.” On October 31, 2023, the District Court dismissed the Complaint, with prejudice, holding that the claims asserted were barred by the applicable statutes of limitations.
