Matthews v. Anthony’s Landscaping and Tree Company

On December 16, 2019, the Honorable Messiah Jackson of the Philadelphia Court of Common Pleas entered summary judgment in favor of Anthony’s Tree and Landscaping Company in a negligence action based upon Anthony’s Tree and Landscaping’s work performed on a tree located on a Prospect Crozer property that subsequently lost a branch which severely injured the Plaintiff.  The court held that Anthony’s Landscaping did not undertake an ongoing duty to ensure tree inspections, tree trimming or tree removal.
